When You Are Getting A Divorce

One of the hardest things that can happen in any family is a divorce. For the adults, it is very stressful and comes with many mixed emotions. For children, it is a very scary time in their lives. They are unsure of what is going to happen to them and can cause them to have problems in their daily lives. Once you have filled out the paperwork, they will be sent to your spouse. At that time, your spouse may contact their own attorney and then the two attorneys will work together on the rest of the proceedings. When you fill out the papers to file, your attorney may have included a list of demands that you want out of the divorce. These could range from custody of your children to who gets to keep the family car. Your spouse’s attorney will review each of these with their client and send back to your attorney any adjustments that need to be made to the demands. Custody issues are typically the most battled over in divorce cases. The adjustments may go back and forth for several weeks before some agreements are reached. If an agreement is reached on the custody issues, visitation rights will be drawn up for the noncustodial spouse. Each item must be split according to the agreements made. In the case of custody, this should be done as it has been spelled out. If alimony or child support is involved, payments should be made as they were directed. Failure to do so can result in jail time. If any parts of the divorce agreement is not done as it should, contact your attorney and he will notify the attorney of your now ex-spouse in order to have them fulfill their duties.

A divorce case can be finalized very quickly if both parties are in agreement but there have been cases where they have gone on for years. You should be aware that your attorney will charge you for the divorce at a flat rate. But if there are any further complications over time, there will be additional fees that you must pay.
