Reasons Why Companies Eventually Need an Attorney

Posted on October 13, 2017July 14, 2019

There are a lot of different reasons why a business will need an attorney. In fact, most lawyers will tell you that you should have an attorney before you even open the doors of your business. Why? Because a good attorney will help to make sure you don’t get sued. If you do get sued, they will have gotten all your ducks in a row in advance so that whatever the claim is will not have any merit. When it comes to any type of business litigation colorado, it’s imperative that you have an attorney that you know and can trust if something happens and you need someone that understands your industry and your business.

Another key reason why a business will need an attorney is because of employment law. It’s hard to manage employees and it’s also hard to stay in compliance with the many different laws and regulations that government the employer-employee relationship. Before you hire an employee, you will need to make sure the contractual agreement is in order so that there is no confusion about what is being promised. For example, if there are any issues with salary, your attorney should have already helped you develop an iron clad employment agreement. Even if you don’t have employees, you might have someone working for you as a contractor. While the same rules do not apply as with employees, there are still laws to follow.

An area of the law as it relates to a business that can be especially complex is Worker’s Compensation. It’s complicated because you have to navigate many different elements of an injury that has happened at work. Just the fact that an injury has taken place is problematic, but there’s also the issue of trying to figure out if there are any permanent damages, which can become a sticky situation. Related to Worker’s Compensation is the development of policies for workplace safety. This is something that an attorney can help a business navigate.

One of the biggest problems that a lot of companies have is dealing with harassment claims. It’s the reason why there are requirements for training all employees on avoiding different types of harassment in the workplace. The way an attorney would help is by providing training to employees and leaders in the company to make sure everyone is on the same page. While there are many online options for training, an attorney can still help to make sure a business understands how the laws have changed. This is especially helpful since there are a lot of changes to employment laws every year.

It makes sense that a business should not wait until they get sued to hire an attorney. They should build a relationship well in advance so that there is a level of trust and confidence in their abilities. In the event that a problem arises, there isn’t a learning curve where the attorney has to figure out the practices of the businesses. They will have already gained the knowledge to provide effective representation.
